Acceptance of These Terms
These Terms of Use apply when you access or use the website operated by APS LLC under the APS brand. By using the website, you agree to these terms. If you do not agree, do not use the website or submit information through it.
Permitted Use
You may use the website for lawful personal or business purposes, including learning about APS property services, contacting APS, and submitting a good-faith estimate request for a property you own, manage, or are authorized to represent.
Prohibited and Abusive Use
You may not:
- Use the website for unlawful, fraudulent, deceptive, threatening, or abusive activity.
- Submit false information, impersonate another person, or misrepresent your authority concerning a property.
- Attempt to disrupt, damage, overload, probe, or gain unauthorized access to the website or related systems.
- Use automated methods to scrape, copy, or submit requests in a manner that interferes with normal website operation.
- Upload or transmit malicious code, unlawful material, or content that violates another person’s rights.
Website Information
APS aims to provide useful and accurate information, but website content may contain errors, omissions, or information that becomes outdated. Service descriptions are general and may not apply to every property, condition, or request. APS may correct or update website information without notice.
Estimate Requests Are Not Contracts
Submitting an estimate request, using the APS Property Assistant, receiving an automated confirmation, or communicating through the website does not create a binding contract and does not guarantee service, availability, acceptance of a project, pricing, or scheduling.
Any final scope, price, schedule, materials, payment terms, and other service terms must be separately reviewed and agreed upon by APS LLC and the customer. Website descriptions, service-plan summaries, timelines selected in the form, and appointment preferences are not final service commitments.
Your Responsibility for Accurate Information
You are responsible for providing information that is accurate, current, and reasonably complete. This includes contact details, property information, project descriptions, measurements, service selections, and your authority to request work for the property. APS may rely on the information you provide when evaluating or responding to a request.
Intellectual Property
Unless otherwise indicated, the website’s text, layout, graphics, logos, photographs, videos, and other content are owned by or used with permission by APS LLC. You may view and use the website for its intended purpose, but you may not reproduce, distribute, modify, publicly display, or commercially exploit its content without permission or another lawful basis.
Customer-Submitted Content
If you submit project information or, when enabled and supported, project photos, you confirm that you have the right to provide that content. You permit APS LLC and its form-processing providers to use the submitted content as reasonably necessary to evaluate the request, communicate with you, coordinate potential service, maintain business records, and address misuse or legal requirements.
Do not submit confidential, highly sensitive, or unrelated personal information through the estimate form.
Third-Party Services and Links
The website uses Formspree to process estimate-form submissions and Cloudflare Pages to host and deliver the site. The website may also link to services operated by others. Third-party services have their own terms, policies, availability, and technical operation. APS does not control third-party websites or guarantee their content or performance.
Website Availability and Changes
APS may update, suspend, restrict, or discontinue all or part of the website when reasonably necessary. The website may occasionally be unavailable because of maintenance, technical issues, service-provider interruptions, or circumstances outside APS’s control.
Reasonable Disclaimers
The website is provided for general information and request intake. To the extent permitted by applicable law, APS LLC does not promise that the website will always be uninterrupted, error-free, or suitable for every user’s particular purpose. These terms do not exclude any rights or obligations that cannot lawfully be excluded.
Limitations of Liability
To the extent permitted by applicable law, APS LLC is not responsible for indirect or consequential losses arising solely from reliance on general website information, temporary website unavailability, misuse of the website, or the operation of a third-party service. Nothing in these terms limits liability that cannot legally be limited.
Responsibility for Misuse
To the extent permitted by applicable law, if your intentional misuse of the website, violation of these terms, or violation of another person’s rights directly causes a third-party claim against APS LLC, you agree to be responsible for reasonable losses and costs resulting from that claim. This does not apply to the extent a claim was caused by APS LLC.
Changes to These Terms
APS may update these terms as the website, business practices, or legal requirements change. The effective and last-updated date at the top of this page identifies the current version. Continued use after an update means the revised terms apply to later website use.
